New health claims process proposed

In comments to the Food and Drug Administration, GMA proposed the establishment of a premarket notification program for qualified health claims on food labels based on the existing model used for generally recognized as safe (GRAS) substances and food contact materials.

The program would include a 60-day comment period in which anyone could submit additional data or refute the claim. GMA said such a system would reduce the burden on FDA while “still requiring the same level of pertinent research and safety information” by those making the claim as well as stringent FDA review. If approved, the claim could be used by any food or beverage company. FDA could review the claim at its discretion based on new research.
