Cups and possibly other foodservice containers were inadvertently excluded from the exemption until the Foodservice & Packaging Institute (FPI) stepped in to correct the error. Another amendment provides an enforcement delay of one full year if the recycling rate drops below 25%. It also delays enforcement of the law until January 1, 1998, and reduces civil penalties for violations. A third amendment exempts containers holding products regulated under the Federal Insecticide, Fungicide and Rodenticide Act and those used to ship hazardous materials.
Oregon law amended
The Oregon House and Senate have approved amendments to the state's Rigid Plastic Container Law. Food containers will be exempt from the law, thanks to a successful amendment that was supported by the Oregon Food Processors.
