NH bill regulates RFID

The New Hampshire House of Representatives approved legislation amending its Consumer Protection Act to include provisions requiring warning labels on products or identity documents containing tracking devices, including RFID.

The bill also regulates the use of RFID or other technologies for tracking individuals and establishes a commission on the use of tracking devices in government and business. Anything with an embedded tracking device would be labeled with a “universally accepted symbol.”

Selling an item containing an RFID device without a warning label would be a misdemeanor. Proponents call it a “simple notification bill,” while opponents—including the American Electronics Association and the Retail Merchants Association of New Hampshire—say it is too limiting of the technology and too onerous on companies wishing to use the technology. The New Hampshire Senate is now considering the measure.
