Drug companies can be sued for defective labels. . .

A recent Supreme Court ruling says consumers can sue drug makers for defective warnings. This contradicts an earlier ruling that did not allow consumers to sue manufacturers of medical devices such as heart stints and artificial joints. Now experts think that drug makers may not be as likely to bring promising drugs to market that pose high risks. The new ruling could also lead to updated labels that list possible side effects, as well as requiring FDA approval of every label update.
