Groups appeal decision on alcohol labeling

Two public interest groups, the Competitive Enterprise Institute and Consumer Alert, are appealing a court decision to dismiss a case against the BATF challenging the agency’s ban on mentioning in advertising or labeling the relationship between moderate alcohol consumption and reduced risk of heart disease.

“The health benefits of moderate alcohol consumption have been documented by some of the world’s foremost epidemiologists, and their findings have been published in leading scientific journals,” said CEI’s general counsel. “Even the federal government acknowledges these benefits. ATF’s ban on any mention of this in alcohol labels and ads is clearly illegal.”

In June 2001, ATF argued that the case should be delayed until it completes new rule making on the subject. The judge agreed and dismissed the case. The U.S. Court of Appeals is hearing the appeal for the D.C. Circuit. A hearing is scheduled for May 9, 2002.
