Flea market law contested

A revised version of New Jersey's new flea market bill is moving through the state legislature after a vigorous public campaign by New Jersey flea market vendors.

The disputed law bans flea market vendors from selling packaged baby food, cosmetics products, and nonprescription drugs with an expiration date. The proposed revision allows such products to be sold (only prior to their expiration dates), though it requires a lawful paper trail of sales of these products. New Jersey's experience highlights efforts by eight trade associations to craft model legislation for flea market vending. By helping to craft such laws, manufacturers hope to reduce the market for shoplifted goods and prevent outdated or damaged products from reaching consumers.
